It is submitted on behalf of the petitioner that the order impugned dated October 30, 2018 passed by the Customs, Excise and Service Tax Appellate Tribunal is founded on a judgment rendered by the Bombay High Court and the validity of such judgment or the issues decided thereunder have been carried to the Supreme Court and the matter is pending consideration. It is submitted that the hearing before the Supreme Court is scheduled in the next two or three weeks.
Let this petition appear four weeks hence for the parties to report whether the legal issues that have arisen have been finally decided.
