ORDER
By asserting that an extent of 1086.5 sq.ft in re-survey no.92/1B2C2 was
purchased by the petitioner’s late father, Ramalingam, under Document No.790
of 2000, the petitioner seeks an inquiry in relation to the allegedly fraudulent
registration of Document No.2295 of 2025 by the 5th and 6th respondents herein.
2. Learned Government Advocate accepts notice for respondents 1 to 3.
He submits that the allegation of the petitioner pertains to alleged lack of title on

the part of the parties to Document No.2295 of 2025. He submits further that
the registering officer is not empowered to determine questions of title.
3. On perusal of the affidavit, it is noticeable that the petitioner alleges
that the 4th respondent registered conveyances without verifying the genuineness
or validity of title documents. In several judgments, including recently in
K.Gopi v. The Sub Registrar, 2025(2) CTC 777, it was held that the registering
officer is not empowered to examine and determine questions of title.
Therefore, no purpose would be served by directing an inquiry. Hence this writ
petition is disposed of by leaving it open to the petitioner to approach the
jurisdictional civil court for relief. No costs. Consequently, the connected writ
miscellaneous petition is closed.
