                PRAYER:
                          This Second Appeal is filed under Section 100 of C.P.C against the
                judgment and decree of the learned Subordinate Judge, Ariyalur made in
                A.S.No.28 of 2011 dated 22.04.2014 reversing the judgment and decree of the
                learned District Munsif, Jayamkondam made in O.S.No.133 of 2005 dated
                28.02.2011.

                                                        JUDGEMENT

When the matter was taken up for hearing on 30.10.2025, the learned

counsel for the appellants reported that the sole respondent died in the year 2021

and sought time to file a memo to that effect. At their request, the matter was

posted today under the caption “for final hearing”.

Though sufficient opportunity was granted to the appellants, no petition has

been filed to implead the legal representatives of the deceased sole respondent. In

view of the same, this Second Appeal is dismissed as abated by efflux of time. No

costs.
