                                                JUDGMENT

The appellant is the sole accused in S.C.No.110 of 2015 on

the file of Additional District and Sessions Judge, Ramanathapuram. By

Judgment, dated 22.07.2019, the appellant had been convicted for the

offence punishable under Section 302 IPC and sentenced to undergo

imprisonment for life and fine of Rs.2,000/- in default to undergo further

period of 6 months simple imprisonment.

2.By order, dated 14.09.2021, in Crl.M.P(MD) No.4747 of

2021, the sentence of the petitioner had been suspended by the Division

Bench of this Court.

3.It is now represented on behalf of the appellant and the

learned Additional Public Prosecutor that the appellant had died on

12.03.2023. The copy of the death certificate and also a report from the

Sub Inspector of Police, SP Pattinam Police Station, Ramanathapuram

have been filed by the learned Additional Public Prosecutor.

4.In view of the fact that the sole appellant died, charge

against him stands abated.

5.Recording the same, this Criminal Appeal stands

dismissed.
