This Writ Appeal is dismissed as withdrawn with liberty to the

appellant to challenge order dated 21.09.2017 within a period of one

month from date of receipt of a copy of this order. Since the appellant

would urge that the cause of action under order dated 21.09.2017 is a

fresh cause of action, none of the observations made under order of this

Court in W.P(MD)No.16323 of 2017 dated 22.10.2019 shall have any

relevance in deciding the challenge to order dated 21.09.2017. No costs.

2.In light of memo dated 27.09.2023 confirming remittance of
