                    PRAYER: Criminal Original Petition filed under Section 482 of the Code of
                    Criminal Procedure, to call for the records in C.C.No.7395 of 2017, on the file of
                    the learned Chief Metropolitan Magistrate Special Court for CCB and CBCID
                    Cases, Egmore, Chennai and quash the same.

                                                           ORDER

This Criminal Original Petition has been filed seeking to quash the

proceedings in C.C.No.7395 of 2017, pending on the file of the Chief

Metropolitan Magistrate Special Court for CCB and CBCID Cases, Egmore,

Chennai.

2.The case of the prosecution is that A1 was working as a casual

labourer in the electricity department and that he impersonated and obtained

a regular employment by portraying himself as one Karunakaran. The further

case of the prosecution is that A2 and A3 had abetted A1 in the commission of

crime. Based on the complaint given by the 2nd respondent, an FIR came to be

registered in Crime No.630 of 2000 against the three named accused persons

for offence u/s.419 and 420r r/w 109 IPC.

3.On completion of investigation, the final report was filed and it was

taken on file by the Court below in C.C.No.8052 of 2006. A2 died and hence,

the charges abated. The case against the petitioner (A3) was split up and was

pending in C.C.No.7395 of 2017.

4.A1 faced trial before the Court below in C.C.No.8052 of 2006. The

Court below on appreciation of evidence, came to a conclusion that the

prosecution has not made out a case and accordingly, A1 was acquitted from

all charges. In view of the same, the present quash petition has been filed by

A3 on the ground that the acquittal of A1 will also enure in favour of the

petitioner (A3).

5.Heard Mr.R.Vivekananthan, learned counsel for the petitioner and

Mr.A.Gopinath, learned Government Advocate (Crl.side) for R1.

6.The Trial Court while acquitting A1 from all charges, rendered the

following findings:

7.In the light of the above finding, if the offence has not been

committed by A1, the petitioner (A3) who is said to have abetted the crime

cannot be made to face a fresh trial before the Court below. In other words,

the judgment of acquittal passed in favour of A1 will also enure in favour of

A3. In view of the above discussion, the proceedings as against the petitioner

(A3) in C.C.No.7395 of 2017, on the file of Chief Metropolitan Magistrate

Special Court for CCB and CBCID Cases, Egmore, Chennai, is hereby quashed https://www.mhc.tn.gov.in/judis

and this criminal original petition is allowed. Consequently, connected

miscellaneous petitions are closed.
