                                                        JUDGMENT

(Delivered by the Hon'ble Chief Justice)

We have heard Mrs.R.Thenamirtha Shyamala, learned counsel

for the appellant and Mrs.A.V.Bharathi, learned counsel for the

respondents.

2. The appellant is running a college of education and

imparting B.Ed course. The appellant was accorded no-objection

certificate, under communication dated 17.2.2021, by the

Government for starting new Under-Graduate courses in B.A.

(Tamil); B.A. (English); B.Sc. (Maths); B.Com.; and B.C.A.

3. The appellant, it appears, applied for affiliation to the

respondent University. A decision was not taken. As such, the

present appellant filed the writ petition.

4. The learned Single Judge dismissed the writ petition holding

that the appellant college is recognised by the National Council for

Teacher Education (NCTE) and it has obtained recognition as a

standalone institution to run B.Ed. course and if the appellant wants

to start allied courses, then permission of NCTE would also be

necessary and the affiliation can be sought only for the related/

allied courses of education.

5. The affiliation of the University is required to start the

Under-Graduate courses in Arts and Commerce. The appellant may

make a fresh application to the respondent University for the

affiliation in the prescribed format along with all the relevant

documents. The University shall consider the application of the

appellant for affiliation on its own merits. It may also consider as to

whether the college of education imparting B.Ed. course can be

permitted to run Arts and Commerce courses. It may further

consider whether the permission of NCTE would be necessary or

not.

With these observations, the writ appeal stands disposed of.

There will be no order as to costs.
