                                                         JUDGMENT

(Judgment of the Court was delivered by R.SURESH KUMAR, J.)

The issue raised in this writ appeal is no more res integra as

number of similar cases have been allowed in favour of the employee

or erstwhile employee and against the appellant State.

2. In this case, since it has been reported before us by the learned

counsel appearing for the respondent that, the respondent is no more and

his wife also is no more and it is very difficult to find out the legal heir of

the respondent.

3. In view of the same, we are inclined to dismiss this writ appeal,

accordingly it is dismissed because of the contesting respondent is no

more and against him it is abated. No costs. Consequently, connected

miscellaneous petition is also dismissed.
