                PRAYER :            Review Application has been filed under Rule 114 of Civil
                Procedure Code and Order XLVII Rule 1 & 2 of C.P.C., to review the order
                passed in W.A.(MD) No.1385 of 2011 dated 15.02.2023 on the file of the
                Madurai Bench of Madras High Court and allow the Review Application.

Review Application is filed on the ground that, this Court has not

considered the dictum laid by the Hon'ble Supreme Court of India in the case

of T.K.Ponnusamy and Others Vs. Government of Tamilnadu and others

reported in 1994 Suppl(3) SCC 376.

2. On perusing the judgement, it is clear that, this Court has taken note of

the said judgment and has discussed about it in detail in para (16) and

distinguished how the case does not fall within the principal laid by the

Hon'ble Supreme Court of India in T.K.Ponnuswamy's case.

3. Hence, this Court finds no new facts for reviewing the earlier petition.

Accordingly, Review Application is dismissed at the SR stage itself.

Consequently, connected miscellaneous petition is closed.
