                                                        JUDGMENT

On earlier occasion, i.e., on 20.06.2023, when the matter came up

for hearing, the appellant was not present. Therefore, the case was listed

under the caption 'for dismissal' today.

2. It is seen that the appeal is of the year 2021. Till date, no notice

was served on the respondent. The appeal is filed as against the order of

maintenance. Learned counsel for the appellant seeks for adjournment.

We are not inclined for adjournment. Even otherwise, it is seen that the

appellant is employed in TATA Consultancy Service and getting a salary

of Rs.65,000/- per month. The trial Court had only ordered Rs.10,000/-

to the daughter as interim monthly maintenance and litigation expenses.

3. In that view of the matter, even on merits, we were are not

inclined to entertain this Appeal. Therefore, the Civil Miscellaneous

Appeal is dismissed. No costs. Consequently, connected miscellaneous

petition is closed.
