                     PRAYER : This Criminal Appeal has been filed under Section 378 of
                     Cr.P.C., to allow the appeal by setting aside the judgment of acquittal
                     passed by the learned Judicial Magistrate (Fast Track) Srivillputur, made
                     in C.C.No.69 of 2013 dated 18.12.2013.

                                                         JUDGMENT

This Criminal Appeal is filed to set aside the judgment of acquittal

passed by the learned Judicial Magistrate (Fast Track) Srivillputur, made

in C.C.No.69 of 2013 dated 18.12.2013.

2.It is seen from the records, even the appeal was not admitted,

only notice was ordered to the respondent. However, for the past several

years, the appellant failed to take notice to the respondent. That apart, no https://www.mhc.tn.gov.in/judis

one was appeared for so many years on behalf of the appellant.

Therefore, this Court has issued notice to the appellant as well as the

respondent. However, no one had take notice to the respondent. When

the matter was listed on 05.04.2023, the learned counsel for the appellant

requested for getting proper instructions from the party. However, the

learned counsel for the appellant has failed to serve any notice to the

respondent. It shows that the appellant has not interested to pursue with

the case, since the appeal is against the acquittal for the offence under

Section 138 of the Negotiable Instrument Act.

3.In view of the same, this Criminal Appeal stands dismissed for

default.
