We have heard Mr.Nagesh Nakhul, learned counsel for the

appellant, Mr.Rajnish Pathiyil, learned counsel for respondents 1 and

2 and Mr.P.Muthukumar, learned State Government Pleader for

respondents 3 and 4.

2. In the typed set of documents now filed by respondents 1

and 2, the copy of the order dated 31.12.2001 is placed on record.

According to the learned counsel for the appellant, the copy of the

said order is received by him just now. The said order was never

served upon the appellant earlier.

3. We would not here adjudicate as to when the copy of the

order dated 31.12.2001 is served to the appellant. The appellant has

now received the order copy. It is for the appellant to take steps as

may be permissible and available under law. It is made clear that we

have not considered the merits of the matter nor the aspect of

limitation.

With the aforesaid observations, the writ appeal stands

disposed of. There will be no order as to costs.
