                     dated 09.04.1991.

                                                          JUDGMENT

This Second Appeal is filed against the Judgment and Decree, dated

06.09.1994 made in A.S.No.46 of 1992 on the file of the Subordinate Court,

Sivagangai, reversing the Judgment and decree, dated 09.04.1991 made in

O.S.No.457 of 1998, on the file of the District Munsif, Manamadurai.

2. On 05.04.2022, the following orders were passed by this Court:

“ Though paper publication was ordered on 04.01.2018, the appellant has not taken steps to effect paper publication.

Steps for 2nd respondent is not taken, it seems the appellant is not interested in the appeal.

Issue fresh notice to respondent Nos.3 and 4 through Court and post returnable by 18.04.2022.

Batta in three days furnishing correct address.

For taking steps for 2nd respondent, call on 18.04.2022 “ finally” .

3. Till today, no steps have been taken to implead the legal

heirs of the deceased 2nd respondent and the notice has also been sent to the

respondents 3 and 4.

4. Today, when the matter is taken up for hearing, there is no

representation for the appellant. Hence, the Second Appeal is dismissed for

non prosecution. No costs.
