                                                     JUDGMENT

This Appeal Suit has been preferred challenging the judgment

and decree dated 28.06.2017 made in O.S.No.22 of 2010 on the file of

the II Additional District Court, Erode.

2. When the matter is taken up for hearing today, the learned

counsel for the appellant/1st defendant and the learned counsel for the

respondents 1 and 2/plaintiffs submitted that the dispute between the

parties, has been amicably settled out of Court. Both the parties are

present and the terms of compromise dated 16.02.2022 along with a

memo, dated 11.04.2022 filed. The compromise memo is read out to the

parties and they accepted the terms of compromise. The terms of

compromise recorded.

3. In view of the compromise memo filed, this Appeal Suit is

allowed in terms of the compromise, as settled out of Court. The

judgment and decree dated 28.06.2017 passed in O.S.No.22 of 2010 by

the learned II Additional District Judge, Erode is set aside. The Memo of

Compromise shall form part of the decree. Registry is directed to refund

half of the Court fee to the appellant as per Rules. No costs.
