                   PRAYER: Second Appeal filed under Section 100 of the Civil Procedure Code, against
                   the judgment and decree dated 29.06.2009 rendered in A.S.No.27 of 2005 on the file of
                   the Subordinate Judge, Tuticorin, confirming the decree and the judgment dated
                   21.04.2004 rendered in O.S.No.89 of 2002 on the file of the District Munsif Court,
                   Srivaigundam.

                                                       JUDGMENT

2. The second appeal is dismissed for non-prosecution. Registry

as cost by the appellant to the High Court Legal Services Committee,

Madurai Bench of Madras High Court, Madurai. Consequently, connected

miscellaneous petition is closed.
