                                                                 ORDER

This is the forth application filed by the applicant u/S. 483 of BNSS for grant of bail relating to Crime No.114/2025 registered at Police Station - Rampurkalan District - Morena (M.P.) for the offence under Sections 103(1), 115(2), 117(2), 109(1), 3(5) of BNS and Section 25(2) of Arms Act. His last bail application was dismissed on merits vide order dated 03.12.2025 passed in M.Cr.C. No. 50650 of 2025.

2. As per prosecution case, Lokendra Singh reported in the emergency ward of Sabalgarh hospital in an injured condition that today on 12.11.2024 at around 07.00 pm, he and his son Girraj Yadav went to their old house in village Simrauda to light a lamp, then Nawab Yadav, Mohan Yadav, Balle and Dilip Yadav came there and said that you will not light a lamp in the house as this place belongs to them, then he said that this is their home too.

2 MCRC-13133-2026 Upon hearing this, the accused began abusing him. When he objected, Nawab Yadav/present applicant grabbed him, and Dilip beaten him with a stick. When his brother Surendra Yadav and nephew Ranvijay Yadav arrived, Balle Yadav stabbed Surendra in the chest. Dilip, then hit Surendra with a stick. Nawab Yadav grabbed his son, Girraj Yadav, and Balle Yadav stabbed Girraj with the intent to kill him, hitting him on the left side of the chest. Girraj fell unconscious at the scene. His condition was critical and he was taken to Sabalgarh Hospital, where the doctor declared him dead. Based on this information, a rural complaint was filed at the Rampur Kalan police station, and a case was registered against the accused under Sections 103 (1) and 3 (5) of the Indian Penal Code, 2023, in Crime No. 114/2024 at the Rampur Kalan police station. During the investigation, sections 115(2), 117

(2), 109 (1) of the Indian Penal Code, 2023 and section 25B of the Arms Act were added and after completion of investigation, the charge sheet was filed in the court.

3. Learned counsel for the applicant submitted that applicant is innocent and has been falsely implicated. The applicant is under custody since 13.11.2024. He already suffered more than one year's jail incarceration as pretrial detention. The present applicant is an old man aged 64 years. According to the prosecution, the only allegation against the present applicant is that he caught the deceased, with no other overt act attributed to him in the incident. It is further submitted that since the rejection of the applicant's previous bail application, co-accused Dilip Yadav and Mohan Singh Yadav have been granted bail vide orders dated 12.03.2026 (M.Cr.C.

3 MCRC-13133-2026 No. 10672 of 2026) and 23.02.2026 (M.Cr.C. No. 6607 of 2026), respectively. Furthermore, as all material prosecution witnesses have already been examined, there is no risk of the applicant influencing said witnesses. The applicant is permanent resident of District Morena (M.P.) and there is no possibility of his absconding or tempering with prosecution case. Under these grounds as well as on the ground of parity, he prays for grant of bail to the applicant.

4. Per contra, learned counsel for the State as well as counsel for the complainant vehemently opposed the bail application and prayed for its dismissal.

5. Heard learned counsel for the rival parties and perused the case diary available on record.

Considering the above submissions advanced by the counsel for the parties and facts and circumstances of the case so also the fact that all material prosecution witnesses have been examined before the trial Court, and without expressing any opinion on the merits of the case, this application i s allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of the trial Court/committal Court.

8. This order will remain operative subject to compliance of the following conditions by the applicant:-

i) The applicant will comply with all the terms and conditions of the

bond executed by him;

ii) The applicant will cooperate in the investigation/trial, as the case may be;

iii) The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Police Officer, as the case may be;

iv) The applicant will not commit any other offence or will not repeat the offence in future. In case, if he is found involving in offence of the same nature, this bail order shall stand cancelled automatically without further reference to the Bench.

v) The applicant will not seek unnecessary adjournments during the trial; and

vi) The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.

vii) The applicant shall mark his attendance at the police station concerned every Sunday until the conclusion of the trial.

9. E- copy of this order be sent to the trial Court concerned for compliance.

10. Certified copy as per rules.
