                                                                  ORDER

Though this application has been filed for grant of regular bail but looking to the seriousness of illness, learned senior counsel for the applicant prays that this application be treated as temporary bail application.

This is the second bail application filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita , 2023/ 439 of Code of Criminal Procedure for grant of regular bail relating to FIR/Crime No.506/2025

registered at Police Station - Devendranagar, District - Panna (M.P.) for the offence punishable under Sections 109(1), 55, 61(2)(A) and 3(5) of BNS and Sections 25/27 of the Arms Act. The applicant is in custody since 17.10.2025. Applicant's first bail application i.e. M.Cr.C. No.59918/2025 was dismissed as withdrawn vide order dated 14.01.2026.

2. On the request of learned senior counsel for the applicant, medical

2 MCRC-12072-2026 report was called from the District Jail, Panna and as per report submitted by the District Jail, Panna, it has been submitted by the learned senior counsel for the applicant that the applicant was complaining pain in the back portion of the head and left side of back and was also complaining numbness in the left hand and after that a panel of doctors has examined the applicant. In MRI of the brain, it has been found that there is cerebral hematoma (edema). Learned senior counsel for the applicant has further submitted that there is no direct involvement of the applicant as the whole case is based upon the memorandum of the co-accused and the applicant is also not named in the FIR as the accused.

3. Learned senior counsel for the applicant has further submitted that looking to the gravity of the illness and the report of the doctors, it would be

proper to release the applicant on temporary bail.

4. Learned counsel for the State has opposed the bail application and has submitted that in the memorandum of co-accused, there is clear statement that the applicant conspired with the co-accused. The applicant has made a conspiracy to murder the victim and in furtherance of that conspiracy, the injury was caused to the victim, therefore, no case of bail is made out, hence, the applicant is not entitled to be released on bail.

5. Heard the parties and perused the case diary.

6. Looking to the seriousness of the illness of the applicant, proper treatment is required, hence, this regular bail application is treated as a temporary bail application.

7. Considering the facts and circumstances brought on record, coupled

3 MCRC-12072-2026 with the facts of the medical report, this Court deems it appropriate to allow the application. Thus, without commenting anything on the merits of the case, the application is allowed.

8. It is directed that the applicant shall be released on temporary bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety of the like amount to the satisfaction of the trial Court concerned. The applicant shall be released on temporary bail for a period of one month on 23.03.2026 at 08:00 am and he shall surrender before the trial Court concerned on 24.04.2026 till 05:00 pm and then, trial Court shall send him to the judicial custody. The trial Court is further directed to send a copy of the applicant's surrender report before this Court.

9. It is further directed that the applicant shall comply with the provisions of Section 480(3) of BNSS.

10. Accordingly, Misc. Criminal Case stands disposed of. Certified copy today.
