ORDER
This is first bail application under Section 483 of BNSS filed by the applicant for grant of bail.
The applicant has been arrested on 19.11.2025 by Police Station- Basai, District Datia in connection with Crime No.134/2025, registered in relation to the offence punishable under Sections 409, 420, 467, 468, 471 of IPC.
The prosecution case, in brief, is that on 18.06.2025, the complainant, who was the then Branch Manager of Punjab National Bank, Basai Branch, District Datia, submitted a written complaint against the accused Shishupal Singh Chauhan, who was working as the Cashier at Punjab National Bank, Basai Branch. The complainant stated that he was posted as Branch Manager at PNB Basai from 01.07.2024 to 12.12.2024. During his tenure, several

2 MCRC-11651-2026 complaints were received by the Circle Head from bank account holders alleging that the accused cashier Shishupal Singh Chauhan was committing fraud with customers of the bank. On inquiry, it was revealed that the accused, during his tenure as cashier, from 10.11.2017 to 22.08.2024, dishonestly misappropriated the money of 164 account holders of the bank. The accused collected cash from customers for deposit in their bank accounts but did not deposit the amount in the bank and instead used the money for his personal purposes. To conceal the fraud, the accused issued deposit receipts to the customers bearing the seal of Punjab National Bank, creating a false impression that the money had been properly deposited in their accounts. By this act, the applicant misappropriated a total amount of ₹1,49,10,403 (Rupees One Crore Forty-Nine Lakh Ten Thousand Four
Hundred Three only) belonging to the customers of Punjab National Bank, Basai Branch. On the basis of the said complaint, the aforesaid crime has been registered against the applicant.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He has not committed any offence. It is submitted that alleged misappropriation of amounts belonging to 164 account holders, however not a single name of any account holder has been mentioned in the FIR. The applicant has not withdrawn any money, nor has he prepared or written any withdrawal vouchers of the account holders. Further, it is submitted that in the present case, the prosecution witnesses in their police statements have stated that the bank manager had returned their money externally without making entries in the bank records.

3 MCRC-11651-2026 This clearly indicates that the applicant has neither withdrawn any amount nor prepared any vouchers relating to the account holders, and therefore the applicant has been wrongly implicated in the present case. Trial will take time for its conclusion. The applicant is permanent resident of District Datia and there is no likelihood of his absconsion or tampering with the prosecution evidence. He is ready to abide by the terms and conditions as may be imposed. With the aforesaid submissions, prayer for grant of bail is made out.
Learned counsel for the State vehemently opposed the application and prayed for its rejection.
Considering the overall facts and circumstances of the case, nature of allegations and coupled with the fact that the trial is not likely to conclude in near future and prolonged pre- trial detention being an anathema to the concept of liberty, this Court is inclined to extend the benefit of bail to the applicant.
Accordingly, without expressing any opinion on merits of the case, this application is allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount to the satisfaction of the trial Court/committal Court for his appearance on the dates given by the concerned Court.
This order will remain operative subject to compliance of the following conditions by the applicant:-
1. The applicant will comply with all the terms and conditions of the bond

2. The applicant will cooperate in the investigation/trial, as the case may be;
3. The applicant will not indulge themselves in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to the Police Officer, as the case may be;
4 . The applicant shall not commit any other offence during pendency of the trial, failing which this bail order shall stand cancelled automatically, without further reference to the Bench;
5. The applicant will not seek unnecessary adjournments during the trial; and
6. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be. Certified copy as per rules.
