ORDER
The present petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 seeking modification of the order dated 14.01.2026 passed in M.Cr.C. No. 697/2026, whereby this Court had granted bail to the applicant. As per the said order, the applicant was directed to deposit a sum of ₹5,00,000/- for his release from jail. It was further directed
that the applicant shall deposit the remaining amount of ₹15,00,000/- within one month from the date of his release, failing which the applicant shall surrender before the Court and undergo custody.
It is submitted by learned counsel for the applicant that thereafter he has filed Miscellaneous Criminal Case No. 8855/2026 before this Court seeking extension of time to deposit the remaining amount of ₹15,00,000/-

2 MCRC-10772-2026 and prayed that six months' time be granted for depositing the said amount. However, this Court dismissed the said application on 23.02.2026. Being aggrieved by the said order, the applicant has filed a Special Leave Petition before the Hon'ble Supreme Court, which has been registered with Diary No. 12797/2026, and the matter is presently under consideration before the Hon'ble Apex Court. Thereafter, the applicant filed the present petition seeking modification of the order with a prayer to grant a stay on depositing the remaining amount of ₹15,00,000/- till the final disposal of the Special Leave Petition.
Learned counsel for the respondent/State opposes the prayer and submits that the condition regarding deposit of the amount was imposed by this Court while granting the benefit of bail, considering the nature and
gravity of the offence. It is further submitted that the applicant has not complied with the said condition till date and no sufficient ground has been made out for modification of the order passed. It is argued that mere financial difficulty is not a valid ground for exercising inherent powers under Section 482 of the Code of Criminal Procedure, 1973 to alter a specific condition imposed at the time of granting bail.
Heard learned counsel for the respondent/State and perused the record. After hearing learned counsel for the parties and upon perusal of the record, this Court finds that while granting bail to the applicant vide order dated 14.01.2026 in M.Cr.C. No. 697/2026, a specific condition was imposed directing the applicant to deposit a sum of ₹15,00,000/- within the stipulated period. 3 MCRC-10772-2026 and gravity of the allegations. It is also noted that the application seeking extension of time to deposit the said amount has already been dismissed by this Court on 23.02.2026. Merely on the ground that the applicant has filed a Special Leave Petition before the Hon'ble Supreme Court does not automatically entitle the applicant to modification or suspension of the condition imposed by this Court. However, in the interest of justice, this Court deems it appropriate to grant one last opportunity to the applicant to comply with the condition imposed earlier.
Accordingly, the applicant is granted time till tomorrow to deposit the remaining amount of ₹15,00,000/- before the concerned Court/authority. It is made clear that in case the said amount is not deposited within the aforesaid time, the bail granted shall automatically stands cancelled and the applicant will have to surrender before the concerned Court and undergo custody.
With the aforesaid directions, the present petition stands disposed of.
