                                                                   ORDER

1. The applicant has filed this first bail application under section 483 of BNSS (439 of Cr.P.C.) for grant of bail. Applicant has been arrested on 22/01/2026 in Crime No.352/2025 by Police Station Bakal, district Katni, for the offences punishable under sections 296 (B), 115(2), 109(1), 103(1), 351(3), 3(5) of BNS 2023.

2. It is the submission of learned counsel for applicant that applicant is a lady, aged about 45 years and is suffering confinement since 22/01/2026.

Charge-sheet has already been filed, therefore, chance of tampering with the evidence/witnesses is remote. It is further submitted that role assigned to present applicant is of causing marpeet to deceased Tilkiya Bai. It was not the case where present applicant lifted deceased and thrashed over the ground. Furthermore, it was other co-accused Harchhat who did the act which constitutes commission of offence of murder. There was no prior

2 MCRC-15431-2026 making of mind and it was the case of sudden provocation prima facie. Co- accused Bhana bai has already enlarged on bail (vide order dated 05/03/2026 passed in MCRC No.5673/2026) although on age ground also. However, allegations against applicant are limited to cause marpeet only. He seeks parity. The applicant undertakes to cooperate in trial/ investigation and would not be a source of embarrassment and harassment to the complainant side in any manner. On these grounds, counsel for applicant prayed for grant of bail.

3.Learned counsel for the State opposed the prayer for bail and prayed for it's dismissal.

4.Heard the learned counsel for the parties at length and perused the case diary.

5. Considering the submissions, especially the nature of allegations against present appellant and factum of parity vis-à-vis co-accused Bhana Bai, but without commenting on the merits of the case, the application is allowed. It is hereby directed that the applicant shall be released on bail on his furnishing personal bond of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one solvent surety in the like amount to the satisfaction of trial Court.

6. This order will remain operative subject to compliance of the following conditions by the applicant :-

(i). The applicant will comply with all the terms and conditions of the bond executed by him;

(ii) The applicant will cooperate in the investigation/trial, as

(iii) The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to the Police Officer, as the case may be;

(iv) The applicant shall not commit an offence similar to the offence of which he is accused;

(v) The applicant will not seek unnecessary adjournments during the trial;

(vi) The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be;

(vii) The applicant shall not be a source of embarrassment or harassment to the complainant side in any manner and shall not move in the vicinity of complainant side.

7. Application stands allowed and disposed of.

8. A copy of this order be sent to the trial Court concerned for compliance and information.

9. Certified copy as per rules.
