                                                                 ORDER

This is second application filed by the applicant under Section 483 of BNSS for grant of bail relating to Crime No. 105/2025 registered at Police Station - Alampur, District - Bhind(M.P.) for the offence under Sections 110, 125, 191(1), 191(2), 191(3), 324(4), 296(A), 351(3), 109, 331(5), 333, 238 of BNS and Section 25, 27 of the Arms Act.

2. The allegation against the present applicant is that he along with

other co-accused persons commited marpeet with the complainant. Accordingly, offence has been registered against him.

3. Learned counsel for the applicant submits that a false case has been registered against the applicant, who has been in continuous confinement since 27.12.2025. It is further argued that there is huge contradictions in the prosecution story and Dehati Nalisi. Investigation is over and charge-sheet

2 MCRC-15516-2026 has been filed in the case. No grievous injury has been caused by the present applicant and the only allegation against him is of causing injury by means of wooden sticks. It is further submitted that the present applicant is the sole breadwinner of his family, and has continued absence has rendered the family without any means of livelihood, causing severe financial hardship and virtual starvation. No further custodial interrogation of applicant is required in the matter. Trial will take sufficient time to conclude. The injured has already been discharged from the hospital. Applicant undertakes to cooperate in trial as well as investigation and would make himself available as and when required. He would abide by the terms and conditions as imposed by this Court. Under these grounds, counsel prayed for bail.

4 . The PP for the State, opposed the prayer and sought dismissal of

the application by submitting that the applicant bear criminal record of seven cases and the eye-witnesses has supported the story of the prosecution.

5. Heard learned counsel for the parties and perused the case diary.

6. Considering the facts and circumstances of the case, particularly the fact that the applicant has been in custody since 27.12.2025 and the investigation is complete, but without commenting on the merits of the case, application is allowed. It is hereby directed that the applicant shall be released on bail on their furnishing personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of trial Court.

8 . This order will remain operative subject to compliance of the following conditions by the applicant:-

3 MCRC-15516-2026 i. The applicant will comply with all the terms and conditions of the bond executed by him;

ii. The applicant will cooperate in the investigation/trial, as the case may be;

iii. The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to the Police Officer, as the case may be;

iv. The applicant shall not involve in any criminal activities in future and shall not commit an offence similar to the offence of which he is accused;

v. The applicant will not seek unnecessary adjournments during the trial;

vi. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.

vii The applicant is directed to mark his presence on every Sunday before Police Station Alampur District- Bhind, till conclusion of trial, failing which this bail order shall stand cancelled automatically, without further reference to this Court.

9. Applications stand allowed and disposed of.
