ORDER
1. The applicants have filed this first bail application under section 483
of BNSS (439 of Cr.P.C.) for grant of bail. Applicants have been arrested on
28/10/2025 in Crime No.372/2025 by Police Station Khalwa, district
Khandwa, for the offences punishable under sections 296, 115(2), 351(3),
3(5), 109(1) of BNS, 2023.
2. It is the submission of learned counsel for applicants that applicants
are suffering confinement since 28/10/2025 and charge sheet has already
been filed. Not only this, material prosecution witnesses have also been
examined in which course of events as unfolded is being narrated. In fact,
injured witness Jogilal try to molest one Gyanvati Bai who happens to be
resident of same village where applicants reside and thereafter, in retaliation,
some scuffle took place between present applicants and other co-accused vis-
à-vis injured Bhogilal. Applicants do not bear any criminal record and

because of conduct of complainant, this incident took place. No weapon was
used by applicants to inflict injury. As per allegations, legs and fists were
used to cause injury to Bhogilal. The applicants undertake to cooperate in
trial/ investigation and would not be a source of embarrassment and
harassment to the complainant side in any manner. They further undertake to
perform community service to purge their misdeed, if any and to serve
national/social/environmental cause. On these grounds, counsel for
applicants prayed for grant of bail.
3.Learned counsel for the State opposed the prayer for bail and prayed
for it's dismissal. However, he fairly submits that applicants do not bear any
criminal record.
4. Heard the learned counsel for the parties at length and perused the
case diary.
5. Considering the submissions, especially the nature of allegations
against present applicants, but without commenting on the merits of the case,
the application is allowed. It is hereby directed that the applicants shall be
released on bail on their furnishing personal bond of Rs.50,000/- (Rupees
Fifty Thousand Only) each with one solvent surety each in the like amount
to the satisfaction of trial Court.
6. This order will remain operative subject to compliance of the
following conditions by the applicant :-
(i). The applicants will comply with all the terms and
conditions of the bond executed by him;
(ii) The applicants will cooperate in the investigation/trial,

as the case may be;
(iii) The applicants will not indulge himself in extending
inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade them from disclosing such facts
to the Court or to the Police Officer, as the case may be;
(iv) The applicants shall not commit an offence similar to
the offence of which they are accused;
(v) The applicants will not seek unnecessary adjournments
during the trial;
(vi) The applicants will not leave India without previous
permission of the trial Court/Investigating Officer, as the case may
be;
(vii) The applicants shall not be a source of embarrassment
or harassment to the complainant side in any manner and shall not
move in the vicinity of complainant side.
(viii). They shall mark their presence at concerned Police
Station on first Sunday of every month for one year i.e. till April,
2027 or till conclusion of trial, which ever is earlier.
7. It is made clear that thisi bail is granted once the case is
made out for bail and thereafter, direction for plantation of
saplings is given and it is not the case where a person intends to
serve social cause can be given bail without considering the
merits.

येक आवेदकगण 10 पौध का (फल दे ने वाले पेड़ अथवा नीम/पीपल)
रोपण करे गा तथा उसे अपने आस पडोस म पेड़ क सुर ा के िलए बाड़
लगाने क यव था करनी होगी ता क पौधे सुर त रह सके।
आवेदकगण का यह कत य है क न केवल पौध को लगाया जाऐ, ब क
उ ह पोषण भी दया जाए। ''वृ ारोपण के साथ, वृ ापोषण भी
आव यक है ।'' आवेदकगण वशेषतः 6-8 फ ट ऊ◌ॅ◌ंचे पौधे/पेड़ को
3-4 फ ट ग ढा करके लगायेगा ता क वे शी ह पूण वकिसत हो
सक। अनुपालन सुिन त करने के िलए, आवेदकगण को रहा कये
जाने क दनांक से 30 दन के भीतर संबंिधत वचारण यायालय के
सम वृ /पौध के रोपण के सभी फोटो तुत करना हे ाग । त प ात ्,
वचारण के समापन तक हर तीन मह ने म आवदे क के ारा वचारण
यायालय के सम गित रपेाट तुत क जाएगी ।
वृ क गित पर िनगरानी रखना वचारण यायालय का
कत य है य क पयावरण रण के कारण मानव अ त व दांव पर है
और यायालय अनुपालन के बारे म आवेदकगण ारा दखाई गई कसी
भी लापरवाह को नजर अंदाज नह कर सकता है । इसिलए
आवेदकगण को पेड़ क गित और आवदे क ारा अनुपालन के संबंध म
एक रपोट तुत करने के िलए िनदिशत कया जाता है एवं आवदे क
ारा कये गये अनुपालन क एक सं रपेाट वचारण यायालय के
सम येक तीन माह म (अगले छः मह न के िलए) रखी जायेगी जसे
क ''िनदश'' शीषक के अतंगत रखा जाएगा।
वृ ारोपण म या पेड़ क दे खभाल म आवेदक गण क ओर से क
गई केाई भी चूक आवेदकगण को जमानत का लाभ लेने से वंिचत कर
सकती है । आवेदकगण को इन पौध /पेड को रोपने क वतं ता होगी,

य द वह इन रोपे गये पेड क गाड या बाड़ लगाकर र ा करना चाहता
है , अ यथा आवेदकगण को वृ के रोपण के िलए तथा उनके सुर ा
उपाय के िलए आव यक खच वहन करना होग।
इस यायालय ारा यह िनदश एक पर ण करण के तौर
पर दए गए ह ता क हं सा और बुराई के वचार का ितकार,
सृजन एवं कृ ित के साथ एकाकार होने के मा यम से सामांज य
था पत कया जा सके। वतमान म मानव अ त व के आव यक
अंग के प म दया, सेवा, ेम एवं क ं णा क कृ ित को वकिसत
करने क आव यकता है य क यह मानव जीवन क मूलभूत
वृितयां ह और मानव अ त व को बनाए रखने के िलए इनका
पुनज वत होना आव यक है ।
यह िनदश आवेदक ारा वे छा से वतः य क गई
सामुदाियक सेवा क इ छा के कारण दया गया है जो वै छक है । ''यह
यास केवल एक वृ के रोपण का न होकर ब क एक
वचार के अंकुरण का है ।''
8 . It is expected from present applicants that they shall submit
photographs by downloading the mobile application (NISARG App)
prepared at the instance of High Court for monitoring the plantation through
satellite / Geo- Tagging / Geo fencing etc.
9. Application stands allowed and disposed of.
10. A copy of this order be sent to the trial Court concerned for
compliance and information.
11. Certified copy as per rules.
