                                                                  ORDER

The grievance of the petitioner is that he has been placed under suspension vide order dated 03.09.2024 and though the charge sheet has been issued subsequently on 16.10.2024 but the authority should take a specific decision whether to continue the petitioner under suspension.

It is contended that earlier the decision was taken to extend the suspension vide letter dated 13.12.2024 (Annexure P-2). However, since then there is change of circumstance and respondents should take decision in the matter of continuation of suspension because the charges against the petitioner are not serious in nature and do

not amount to any grave misconduct. Learned counsel for the petitioner relies on the judgment of Supreme Court in the case of Ajay Kumar Choudhary v. Union of India, (2015) 7 SCC 291.

Considering the aforesaid, the petitioner is directed to submit a fresh representation to respondent No.3 who will advert to the said representation and take a decision in the matter of desirability of continued suspension of petitioner in accordance with law. Let appropriate decision be taken within a period of one month
