I.A.No.7539/2025 and 8171/2025 is taken up, which are applications

for urgent hearing during vacation.

2. Considering the reasons assigned in the applications, the applications are allowed.

3. Heard on I.A.No.492/2025, which is an application for suspension of sentence.

4. The applicant has assailed the judgment of conviction dated 12.06.2024 passed by JMFC Mahidpur, District Ujjain in RCT NO.400004/2016 whereby the applicant has been convicted under Sections

420/34, 384/34 of the Indian Penal Code,1860 and sentenced to undergo 2 years and 1 year RI respectively, with fine and default stipulations. The applicant also assailed the judgment of the appellate Court affirming the aforesaid conviction vide judgment dated 28.12.2024 passed in Cr.A. No.25/2024.

5. Learned Senior Advocate appearing on behalf of applicant submits

2 CRR-189-2025 that applicant has surrendered before the trial Court on 28.02.2025 and since then he is in custody. He further submitted that applicant is having good case on merits and there are ample possibilities of success in the present revision petition. The revision will take considerable time for final decision. Applicant was on bail during trial and appeal. Under these circumstances, counsel prayed for suspension of remaining jail sentence during pendency of the present revision petition.

6. Per contra, learned Government Advocate opposes the application on the ground that the prosecution proved the case beyond reasonable doubt. The appellate court has also examined the material available on record. He further submits that no legal question is involved in the case and the present

application is liable to be dismissed.

7. After considering the fact that the applicant is in custody since 28.02.2025 and there are bleak chances of disposal of the present revision petition in near future, I deem it proper to suspend the remaining jail sentence of the applicant till decision of revision. Consequently, the application is allowed.

8. Upon depositing the fine amount, if already not deposited and on furnishing a personal bond of Rs.50,000/- (Rupees Fifty thousand only) along with the surety of the said amount to the satisfaction of the trial court, the remaining jail sentence of the applicant shall remain suspended till decision of this revision and he shall be released on bail. The applicant shall appear before the Registry of this Court on 13.08.2025 and all other

3 CRR-189-2025 subsequent dates as may be fixed by the Registry in this behalf.

List the revision petition for hearing on admission after receipt of record of trial court and appellate court.
