                                                                ORDER

1. The present petition under Section 482 of Cr.P.C/528 of BNSS, 2023 has been filed by the petitioners seeking quashment of the FIR registered at Police Station- Mahila Police Station, District- Shivpuri (M.P.) at Crime No.17/2021 for the offence punishable under Sections 498-A, 323, 294, 34 and 406 of IPC and Section 3/4 of Dowry Prohibition Act and all

consequential proceedings arising therefrom, on the basis of compromise.

2. Learned counsel for the petitioners submits that the parties have resolved the dispute and want to settle the matter once and for all and therefore, preferred applications under Section 320(1)/359(1) & 320(2)/359(2) of BNSS (I.A.Nos.18831/2025 and 18833/2025) to compound the offence. The factum of compromise has already been verified by the

2 MCRC-40036-2025 Principal Registrar of this Court. According to verification report, compromise has been reached between the parties voluntarily without any threat, inducement and coercion.

3. The Hon'ble Supreme Court in catena of judgments Jagdish Channa & others Vs. State of Haryana & another, AIR 2008 SC 1968, Madan Mohan Abbot Vs. State of Punjab, AIR 2008 SC 1969, Shiji Vs. Radhika & Another, (2011) 10 SCC 705, Narinder Singh & others Vs. State of Punjab (2014) 6 SCC 466, B.S. Joshi and others Vs. State of Haryana and another (2003) 4 SCC 675, Gian Singh Vs. State of Punjab (2012) 10 SCC 303 and Parbatbhai Ahir alias Parbatbhai Bhimsinhbhai Karmur and others Vs. State of Gujarat and another, (2017) 9 SCC 641 , laid down that even in non- compoundable cases on the basis of compromise, FIR/Criminal Proceedings

can be quashed so that valuable time of the court can be saved and utilized in other material cases.

After hearing learned counsel for the parties and taking into account the law laid down by the Apex Court, in the opinion of this Court, continuance of trial in such matter will be a futile exercise which will serve no purpose. Therefore, applications are allowed, permission to compound the offence is granted and parties are permitted to compromise the matter.

5. Resultantly, the petition is allowed. FIR dated 16/09/2025 registered at Police Station- Pohari, District- Shivpuri (M.P.) at Crime No.277/2025 for the offence punishable under Sections 498-A, 323, 294, 34 and 406 of IPC and Section 3/4 of Dowry Prohibition Act and all consequential proceedings arising therefrom are hereby quashed against the petitioners on the basis of

3 MCRC-40036-2025 compromise. Petitioners are discharged from all the charges.

6. Petition stands allowed and disposed off in above terms.

7. Copy of this order be sent to the trial Court concerned for compliance.
