Heard on I.A. No.2030/2024, an application for suspension of execution of judgment and decree passed by trial court dated 20.01.2024 in civil suit No.818-A/2020.
Learned counsel for the appellant submits that present appeal has been filed against the judgment and decree passed by trial court in civil suit No.818- A/2020 and also submits that if during the pendency of the appeal, the final decree is passed then this appeal will become infructuous. Hence, he prays for stay of the execution of the preliminary decree till the disposal of this appeal.
Learned counsel for the respondent opposed the aforesaid application by filing written reply and prayed for rejection of the same.
After hearing learned counsel for both the parties, in the interest of justice, trial court is directed not to pass final decree till disposal of this appeal.
Heard on the question of admission.
Appeal is admitted for final hearing.
List the same in due course.
