Per: VINAY SARAF By the present petition, the petitioner has challenged the order dated 17.01.2024 whereby he was directed to handover the vacant possession of the Catering Stall allotted to the petitioner by the respondents at Chhitaurgarh Railway Station on account of completion of the period of license.

Counsel for the petitioner submits that the license of the petitioner may be extended or renewed and the present petition has been preferred with a prayer to issue necessary direction to the respondent to extend the license period of the petitioner. He further submits that in similar circumstances Delhi
High Court delivered the judgment on 30.05.2024 in the matter of Ved Prakash Mishra V/s Union of India and others in Writ Petition (C) No.6771 of 2024 and granted three months time to the petitioner therein to vacate the catering units in question. Hence, he prays for grant of similar relief to the present petitioner.
03. Shri Sudhanshu Vyas, learned senior standing counsel on behalf of the Union of India has opposed the prayer of the petitioner for extending /
renewing the license however, he has not opposed the prayer for grant of some

breathing time to the petitioner to vacate the catering stalls.

Considering the fact that the petitioner is doing business there since 2019 and Delhi High Court in similar circumstances in the matter of Ved Prakash Mishra (supra) has granted three months time to the petitioners therein to vacate the catering units in question. Therefore, in order to maintain parity, the present petition is disposed of with a liberty to the petitioner to vacate the catering stall on or before 30.09.2024 and the respondents are restrained from taking any coercive action before 30.09.2024. The petitioner shall be liable to pay usual license fees for the extended period of three months.
05. With the aforesaid liberty, this Writ Petition is disposed of.
