There is impugned order dated 4.8.2018 (Annexure A/6) which is the order of the learned appellate Court passed in R.C.A. No. 98A/14, judgment

and decree dated 4.8.2018 by which the appeal of the plaintiff was allowed and judgment and decree dated 30.09.2014 of the trial Court was set aside and it was further directed to the lower Court to grant opportunity of hearing to both the parties to object on the Commissioner report dated 11.09.2014 and then decide the matter further with liberty that if parties want to examine Commissioner then permission should be granted and decide the matter.

Vide order dated 2.11.2018 execution and operation of the impugned order and decree dated 4.8.2018 was stayed till the next date of hearing.

As none appears inspite of service, matter can be heard finally on the

merit as record is received, therefore, list the matter for final hearing in the next week as consented by the counsel for the appellants.

Interim relief, if any, shall continue till the next date of hearing. C.C. as per rules.
