Heard on IA.No.3123/2023, an application under Section 389(1) Cr.P.C. for grant of temporary suspension of sentence filed on behalf of sole appellant - Rajesh Kewat on the ground of his ill health.
Appellant stands convicted under section 302 of IPC and sentenced to
undergo Life Imprisonment with fine of Rs.1000/- and under Section 25 of Arms Act and sentence to undergo 1 year's R.I. with fine of Rs.500/- & Under Section 27 of Arms Act and sentence to undergo 2 years' R.I. with fine of Rs.500/- with default stipulations vide judgment dated 4/12/2019 in ST No.527/2017 passed by Ninth Additional Sessions Judge, Gwalior (M.P.).
Having seen the medical report requisitioned from the concerned Central Jail, we are of the view that no case is made out for grant of temporary suspension of sentence to appellant.
Accordingly, IA.No.3123/2023 stands dismissed.
It is needless to say that apellant is being provided the adequate treatment in the jail hospital as reflected from the medical report.
