I.A. No.2931/2020 for suspension of sentence is taken up arising out of judgment dated 06.02.2016 passed in S.T. 394/2014 by Second Additional Sessions Judge, Jabalpur.

At the outset, Shri Vikesh Pratap Singh submits that no previous application for suspension of sentence was decided on merits. He reiterated the same stand despite repeated query from the Court. Similar is the averment in I.A. No.2931/2020 that I.A. No.8672/2017 was withdrawn on 27.04.2018.

The order dated 27.04.2018, on the contrary shows that it was dismissed on merits. Because of calculated misrepresentation, we are not inclined to suspend the remaining jail sentence.

Accordingly, I.A. No.22931/2020 stands dismissed.
