      Shri A.K.Nirankari, learned Public Prosecutor for the respondent/State.

Heard on I.A. No.10421 of 2023, an application under Section 389 Cr.P.C. filed on behalf of appellant Ram Singh seeking temporary suspension of sentence on the ground of marriage of his niece namely, Bharti.

Appellant stands convicted under section 302/149 of IPC and sentenced

to undergo life imprisonment with fine of Rs.250/- and under section 148 of IPC and sentenced to undergo one year's R.I. with default stipulations vide judgment dated 08.01.2016 passed by First Additional Sessions Judge, District Ashoknagar Madhya Pradesh in Sessions Trial No. 125/2010.

Learned counsel for the appellant submits that the marriage of niece of appellant, namely, Bharti is going to be solemnized on 22nd of June, 2023. He has placed on record the marriage card along with affidavit bringing on record the factum of marriage. It is submitted that in the obtaining facts and circumstances, the appellant be enlarged on temporary bail.

Learned counsel for the State has verified the factum of marriage of niece of the appellant through the concerned police station.

Taking into consideration the facts and circumstances of the case, it is directed that the appellant Ram Singh shall be taken in police custody on 22.06.2023 to the venue of marriage at 10:00 am and be allowed to participate in the marriage ceremony. He shall be lodged back in jail on 23rd of June, 2023. For this purpose, arrangements shall be made by the State authorities.

In view of the aforesaid, I.A.stands allowed and disposed of. CC as per rules.
