IN THE HIGH COURT OF MADHYA PRADESH
AT JABALPUR
WA No. 1008 of 2022
(THE STATE OF MADHYA PRADESH AND OTHERS Vs BADRI LAL @ BADREELAL)
Dated : 14-06-2023
Shri Ankit Agrawal - Government Advocate for the appellants/State.
None for respondent.
I.A.No.11089 of 2022 seeking condonation of delay of 985 days is taken up.
It is submitted that after decision of Writ Petition No.21308 of 2018,
State filed Review Petition No.100 of 2020 which was decided on 27/04/2022. Thereafter, the decision was taken to file this writ appeal. Some time is consumed in examining the orders of Single Bench and Division Bench which passed the review order. The delay was unintentional and had taken place in official process. Thus, little delay after the judgment of review petition may be condoned.
The respondent has not chosen to file any reply. Learned counsel for the respondent is also not present. We are satisfied with the cause shown in the application, accordingly,
I.A.No.11089 of 2022 allowed. Delay in filing the appeal is hereby condoned.
The appeal is formally admitted for final hearing. Parties appearing in connected matters agreed to argue the matters finally in the week commencing 24/07/2023.
Shri Ankit Agrawal, learned Government Advocate undertakes to keep the original record for perusal of the Court at the time of final hearing.
List the matter along with connected matters for final hearing in the week commencing 24/07/2023.
