Learned counsel for the petitioner submits that in similar nature of

petitions, the coordinate Bench has directed the respondents to permit the petitioner to participate in the interview subject to outcome of this petition.

Learned counsel for the respondents Shri B.D. Singh and Shri Parag Tiwari has not disputed this fact but it is pointed out that the coordinate Bench while passing the interim order has not taken into consideration the decision rendered in the case of W.P. No.23828/2022 dated 29.11.2022 which has been upheld by the Division Bench of this Court in W.A. No.1706/2022 dated 25.01.2023. It is submitted that strictly as per the direction and decision of this Court, the normalization process has been done.

Considering the submissions of the learned counsel for the parties though while passing the interim orders, the judgment passed by W.A. No.1706/2022 has not been taken note of. However, on the ground of parity, same order is passed and the respondents are directed to permit the petitioner to participate in the interview which is going to be held from 09.08.2023 however, the result shall be subject to the final outcome of the petition. It has been pointed out that the bunch of petitions having similar issues have been listed on 11.07.2023. The Office is, therefore, directed to list this petition along with W.P.
