After hearing the parties and on perusal of the record, I.A. No.1083/2023, an application for taking additional documents on record, is

allowed.

Heard on I.A. No.7806/2022, an application for stay of impugned judgment and decree dated 02.07.2022 passed in RCSHM No.32/2020 by Additional District Judge, Patan District Jabalpur, whereby decree of divorce has been granted in favour of the wife/respondent. While granting decree, the ld. trial Court further granted maintenance of Rs.3,00,000/- under Section 25 of the Hindu Marriage Act, 1955 to be paid in three equal installments within a year and Rs.5,000/- per month to the wife till she remarries.

The appellant is aggrieved as the wife has initiated execution

proceedings.

Admittedly, the wife has solemnized second marriage on 08.08.2022 which find mention in paragraph 4 of the reply filed by her on 28.10.2022.

Having regard to the aforesaid, I.A. No.7806/2022 stands allowed. The judgment and decree dated 02.07.2022 is stayed qua permanent alimony and maintenance granted to the wife till further orders of this Court.

This is an admitted appeal.

appointed by Secretary, High Court Legal Services Committee to explore any possibility to resolve the dispute between the parties.
