Mr. Abhishek Dubey, learned counsel for the appellant seeks permission to withdraw IA No.257/2023 with liberty to file appropriate application in the

light of judgment of Supreme Court in the case of Rajnesh Vs. Neha and another reported in 2021 (2) SCC 324.

Ms. Choudhary, learned Senior counsel for the respondent has no objection.

Accordingly, IA No.257/2023 stands dismissed as withdrawn. At this stage, leaned counsel for both the parties submit that the matter may be sent for mediation.

Prayer is allowed.

As agreed, parties shall appear before the High Court Mediation Center

on 08.02.2023 at 2:15 p.m..

The Registry shall appoint a mediator before that date. List thereafter along with the mediation report.
