                                  T h is appeal coming on for order this day, t h e cou rt passed the
                           following:
                                                                ORDER

This appeal has been preferred against the judgment dated 03.03.2010

delivered in Sessions Trial No.489/2009 by the Fourth Additional Sessions Judge, Bhopal, District Bhopal by which the appellant was convicted for the offence punishable under Section 411 of IPC and has been sentenced to imprisonment till rising of the Court and a fine of Rs.5,000/-, with default stipulations.

2 . During the pendency of this case, possibility of settlement through mediation was explored and this Court vide order dated 02.11.2023 had referred the matter for mediation.

3 . A s per the report received from the learned Principal District and Sessions Judge, Bhopal, the mediation is successful. Report of mediator Shri Rajeev K. Pal, Sixth Additional District and Sessions Judge, Bhopal dated 29.11.2023 is annexed therewith. This report intimates that a compromise has taken place between the parties.

4. After due consideration of mediation report, it appears that parties have arrived at compromise with their own free will and no coercion or inducement was exercised to reach to this amicable settlement between them. Therefore, the instant criminal appeal is allowed and appellant is acquitted of the charges of offence punishable under Section 411 of IPC.

5. The fine amount, if any, deposited by the appellant shall be returned to him.

6. The bail bond of appellant is discharged.

7. A copy of this order alongwith the record be sent to the concerned trial court.
