In compliance of order dated 20.11.2023 counsel for the State has filed verification report wherein it is stated that appellant No.2-Prakash has died on 15.11.2014.

In view of above, the instant appeal stands abated qua appellant No.2- Prakash. The appeal shall continue for appellant No.1-Suresh.

Appeal is of the year 2003.

Appellant has been convicted under Section 325/34 IPC and sentenced one year RI & fine Rs.500/- with default stipulation.

Principal District and Sessions Judge, Raisen is directed to appoint a Mediator, who shall call the parties and conduct the mediation proceedings. Mediator is directed to submit its report as expeditiously as possible.

Registry is directed to send copy of impugned judgment and other

relevant documents to the Principal District and Sessions Judge, Raisen.

List the matter alongwith Mediation report in the last week of January, 2024.
