This appeal coming on for admission this day, th e court passed the
following:
ORDER
Name of respondent No.1 Rampalsingh has been deleted from the cause title vide order dated 05/07/2019.
2. Heard on I.A.No.25925/2021, which is an application for withdrawal of appeal.
3. The aforesaid application has been filed seeking withdrawal of the appeal by stating that matter has been amicably settled between the parties, therefore, appellant wants to withdraw the appeal. Application is supported by the orders passed in other pending matters between the parties.
4. Learned counsel for the respondent No.3 submits that he has no objection if the application is allowed.
5. The appellant has preferred this appeal under Section 378 of Cr.P.C. against the judgment dated 04/03/2013 passed by Judicial Magistrate First
Class, Mandsaur in Criminal Case No.842/2009, whereby the accused person / respondents No.1 to 3 have been acquitted from all the charges.
6. In view of the aforesaid, I.A.No.25925/2021 is allowed and appellant is permitted to withdraw the appeal.
7. Accordingly, the criminal appeal stands dismissed as withdrawn. Bail bonds furnished by the respondents stand discharged.
8. Let record along with the copy of this order be sent to the concerned trial Court for information and necessary compliance.
