Counsel for the appellant submits that the learned trial Court has acquitted the respondent only on the basis that the complainant was unable to establish his financial capacity which cannot be base of acquittal of the

accused, hence, prays for leave to appeal may be granted.

In view of the impugned judgment as well as the contention of the counsel for the appellant, this appeal seems to be arguable, hence, leave to the appeal is granted.

The respondent is already appearing in the matter. Issue notice to the respondent on payment of process fee within seven working days for admission, returnable within four weeks.
