Heard on the question of admission. This second appeal is admitted for hearing on the following substantial questions of law:-

(a) Whether the first appellate Court has committed a gross error of law i n reversing the judgment and decree passed by the trial Court by mis- appreciating and misconstruing the evidence, particularly the documentary evidence available on record proving title of plaintiff over the suit land ?

( b ) Whether recording of name of the Collector over the suit land is illegal and without jurisdiction in the facts and circumstances of the case ?

(c) Whether from the State of evidence as is available on the record, plaintiff has proved his title to the suit land ?

( d ) Whether a temple can be assumed a public temple without any

material evidence and relevant notification of the State Government ?

Issue notice to the respondent on payment of process-fee within a period of seven working days by RAD Mode. Notice be made returnable within six weeks.

List after six weeks.
