In compliance of order dated 21.07.2023 report from District Jail, Dhar has been received. According to which, in this criminal case i.e. S.T.No.471/2008, this appellant has undergone 15 years 4 months & 6 days of
actual period of sentence including 5 years 3 months & 9 days remission but in another S.T.No.355/2008 in which he was convicted under Section 302/34 of the IPC, he had undergone 4 years 3 months & 29 days.
Appellant Raju @ Gandhi @ Rajkumar filed the criminal appeal against the judgment passed in S.T.No.355/2008 i.e. Criminal Appeal No.1068/2012 which is pending before this Court and in the said appeal the benefit of suspension has been granted solely on the ground that he had completed more than 14 years of jail sentence which is factually incorrect.
Shri Golwalkar, Advocate prays time to seek instruction.
Learned Govt. Advocate also prays for time to do the needful. Time granted.
List the case after two weeks alongwith Cr.A.No.1068/2012.
