By this application, the appellant has prayed for direction to the SDO Bunda (Sagar) to proceed with the trial of Case No. 12/2014 (under Section 145

of Cr.P.C.) and to pass final order within 45 days.

The present appeal is pending. In the light of the judgment passed by the Apex Court in the case of Ram Sumer Puri Mahant v. State of U.P., reported in AIR 1985 SC 472 no such direction can be issued.

Accordingly, I.A. No. 4380/2023 is hereby dismissed.
