Heard on I.A. No.5838/2022, an application under Section 482 of Cr.P.C moved on behalf of the petitioner seeking permission to surrender himself before the concerned trial Court and apply for regular bail.

Learned counsel for the petitioner has submitted that on the date of the judgment i.e. on 16.02.2022, the petitioner was admitted in hospital due to chest pain, therefore, he could not appear before the appellate Court. It is further submitted that now the petitioner is ready to surrender himself before the trial Court and counsel prayed for directions to the trial Court to consider and decide the regular bail application if any filed by the applicant on the same day.

As per Rule 48 Chapter X of M.P. High Court Rules, 2008, criminal revision is not maintainable unless the petitioner is behind the bar or has surrendered himself before the trial Court. Therefore, the petitioner is directed

to surrender himself before the concerned trial Court within seven days from today, however, no direction can be issued to trial Court for deciding the bail application to be filed by the petitioner before the trial Court after his surrender. The trial Court is at liberty to decide the petitioner's bail application in accordance with law.

Petitioner is directed to file certified copy of the concerned trial Court's
