This application under Section 482 of Cr.P.C. has been filed
seeking following reliefs:
It is, therefore, most respectfully prayed that petition of petitioner may kindly be allowed and trial court may kindly be directed to conduct speedy trial, complete the trial within stipulate time or as early as possible in the interest of justice.
The applicant is facing trial for offence under Sections 363, 366,
376(2)(n) of IPC and under Sections 5(L) and 6 of the POCSO Act.
The minor prosecutrix was recovered from the possession of the
applicant.
In the light of the judgment dated 11.3.2022 passed in SLP
(Crl.) Diary No.30839/2021 by the Supreme Court in the case of
M. Gopalakrishnan & Ors. vs. Pasumpon Muthuramalingan &
Anr., it is not desirable for this Court to give a direction to the Trial
Court to take up the trial on priority basis.
Accordingly, the application fails and is hereby dismissed.
However, it is observed that since the applicant is in jail, therefore the
Trial Court shall make every endeavour to conclude the trial
expeditiously without disturbing its calendar.
