Heard on admission.
This Appeal is admitted on the following substantial questions of law;
(i) Whether the Courts below erred themselves in declaring the
plaintiff to be owner of land in dispute only on the basis of
khasra entries?
(ii) Whether the Courts below erred themselves to pronounce
the judgment on the basis of plaintiff being owner only on the
basis of patta in absence of pleadings regarding patta?
Issue notice to the respondents on payment of process fee through Ordinary
as well as RAD mode within seven working days. Notice be made returnable within four weeks.
In view of facts and circumstances of this case, till the next date of hearing, status quo in regard to possession as it exists today shall be maintained by the rival parties.
