T his appeal has been preferred by the appellant against the impugned judgment dated 28.12.2010 passed by 10th Additional Sessions Judge, Bhopal, in S.T. No.408/2010; whereby, the appellant has been convicted under Section 392 of IPC and sentenced to undergo RI for three years and to pay fine amount of
Rs.1000/- with default stipulation.
As per the report received from SHO Koh-e-Fiza District Bhopal dated 23.09.2021 sole appellant-Saleem @ Paleet s/o Abdul Saiyad died on 27.04.2015. A copy of death certificate is annexed with the communication.
No one is present to prosecute the appeal.
Therefore, in view of the law laid down by the Apex Court in the case of Daya Singh Lohariya vs. State of Rajasthan (2007) 5 SCC 366 and by the Jharkhand High Court in the case of Sarula Munda vs. State of Bihar 2011(3) Cr.L.J. 3639, without entering into the merits of the case, the appeal is dismissed
having been rendered infructuous.
Let a copy of this order be sent to the jail authorities as well as to the concerned trial Court for information and necessary action.
