Learned counsel for the appellant submits that he has filed amended appeal memo vide document no.14991/2021 to remove the defect as pointed out by the Registry.
After due consideration, the same is allowed and amended appeal memo be
attached with the earlier appeal memo.
Also heard on IA No.30152/2021, an application for ignoring the defect No.2, 5 and 6 as pointed out by the Registry.
Learned counsel for the appellant submits that appeal was filed by the appellant through jail authorities alongwith application under Section 5 of limitation Act. Therefore, affidavit in support of aforesaid application and certified copy of the impugned judgment were not required in the matter.
As appeal was filed by the appellant through Jail Authorities, after due consideration the aforesaid IA is allowed and counsel for the appellant is directed
to cure the defect No.1 as pointed out by the Registry.
Let the record of Court below be requisitioned. List in the week commencing 21.03.2022.
