As per office report, respondent No.1 - Kaushlendra Singh, Collector Gwalior is served. However, since respondent No.2-Vivek Tiwari, the-then District Marketing Officer, MP Sahakari Vipnan Sangh Maryadit, Gwalior has been transferrd, is not served with notice.
Shri Bahirani seeks leave to substitute the present incumbent serving on the post of District Marketing Officer, MP Sahakari Vipnan Sangh Maryadit, Gwalior, in place of Shri Vivek Tiwari, and pay process fee.
Prayer accepted. Let amendment application be filed within three days, thereafter case be posted for consideration on the said application.
In the meantime, learned Government Advocate is directed to seek instruction from respondent No.1 in the backdrop of the fact that vide judgment dated 25.03.2021 in Criminal Appeal No. 11/2021 the Sessions Judge has quashed the impugned order dated 30.12.2020 passed by Collector, District Gwalior about confiscation of the truck bearing registration No. MP06-E-6911 along with paddy (dhan) loaded thereupon.
List this case for further orders on 27th January, 2022. Copy of the order passed today be supplied to Shri Jitesh Sharma for officially onward transmission.
