This criminal revision has been filed by the applicants being aggrieved by the order dated 23.12.2021 passed by the learned Second Additional Sessions Judge, Bijawar, District Chhatarpur in S.T.No. 89/2016.
Learned counsel for the applicant submits that the case was fixed for
judgment on 23.12.2021, however, before the judgment, the trial Court has amended the charges under Section 216 of the Cr.P.C. without affording any opportunity to the petitioners to further cross-examine the prosecution witnesses.
Considering the averments of the learned counsel for the applicants and the impugned order passed by the trial Court and looking to the fact that the case is pending since the year 2016, in the interest of justice, it is directed that the trial Court shall afford one opportunity to the applicants to further cross- examine injured witnesses Jagatraj, Surendra and Digvijay on a date to be
fixed by the trial Court.
It is made clear that if the applicants fail to cross-examine the aforesaid witnesses on the date so fixed by the trial Court, no further opportunity shall be provided to the applicants in this regard.
With the aforesaid direction, this criminal revision is allowed to the extent mentioned above and disposed of.
