The reply should also answer the contention of the petitioner that the issue raised herein is no more res integra in view of judgment in the case of Surya Roshni Vs. State of M.P. reported in 2013(22) STJ 147 (M.P.) and the order passed by a Coordinate Bench on 29.06.2015 in W.P. No.8475/2015 (M/s Makson Nutrition Food (I) Pvt. Ltd. Vs. Assistant Commissioner, Commercial Tax & Others).
Let the case be taken up in the week commencing 07.03.2022. Learned counsel for petitioner further informs that the entry tax as per the impugned demand has already been deposited under protest.
